The PSI outline gives ten Part 1 items to Comply with Laws, and "Georgia Construction Industry Licensing Board" is one of its six named topics. The governing statute is O.C.G.A. Title 43, Chapter 14 (not Chapter 41, which covers residential and general contractors). Chapter 14 was re-enacted by the 2026 General Assembly (SB 553) effective July 1, 2026, and this lesson is written from that current text. Where the new text changed a number that older study guides still print, the old value is noted so you recognise it on an exam item written before the change.
1. Who needs the licence — 43-14-2 and 43-14-8(b)
- Electrical contracting is the installation, maintenance, alteration or repair of any electrical equipment, apparatus, control system or wiring device attached to or incorporated into a building or structure in Georgia. Low voltage contracting is a separate licence (Classes LV-A, LV-T, LV-G, LV-U) and is excluded from the definition.
- An electrical contractor is an individual licensed by the Division of Electrical Contractors as Class I or Class II who bids for, offers to perform, claims the capacity to perform, or performs electrical contracting under an express or implied contract.
- No person may engage in electrical contracting without a valid licence, and a person without a licence may not advertise as being in the business unless the work is performed by a licensed contractor (43-14-8(b)). Advertising without a licence is itself prima-facie evidence of a violation (43-14-17(b)), and the investigator does not have to catch the work in progress to prove unlicensed practice (43-14-17(a)).
- A partnership, LLC or corporation may do electrical contracting only while a licensed person who is actively engaged in the business full time is regularly connected with it (43-14-8(d)). If that licensee dies, the partners, officers and employees may keep operating under the licence for 90 days (the division may grant one more 90-day grace period). The firm must notify the division within seven days when the qualifying licensee severs the connection.
